Apple has filed a complaint against the Motorola Xoom with the same court which granted the company a preliminary injunction which banned the distribution of the Samsung Galaxy Tab 10.1 in Europe.
FOSS Patents reports that Apple filed a complaint about Motorola Xoom’s design with the District Court of Dusseldorf in Germany.
While it has filed for a permanent injunction, is unclear if it filed for a preliminary injunction, which is why the distribution of the Samsung Galaxy Tab 10.1 has ceased in Europe right now.
It’s thought that Apple was unable to get a preliminary injunction as it was aware of Motorola’s Android tablet for too long. While there is no time limit, lawyers tend to discourage filing for a preliminary injunction after knowing about the alleged infringement for more than a month.
Apple and Motorola are already engaged in legal disputes in the US over smartphone technology. They were due to meet in court later this month, but the case was postponed after the judge retired.
Apple also won a preliminary injunction against a company called JAY-tech over a tablet which may have run on the Android operating system.
