There is considerable divergence of opinion between Ireland and the rest of Europe on the meaning of ‘personal data’. Despite guidance issued by the Article 29 Working Party and the Data Protection Commissioner, many practical difficulties remain. Furthermore, the European Commission is proposing changes to the definition in the new regulation.
